Terms of Service

American Driving Academy reserves the right to update and change the Terms of Service without notice.

Account Terms

This page contains the most current version of the Terms of Service.

• You agree that American Driving Academy can send you booking reminders, relevant information and other marketing via phone, SMS and/or email. You can opt out of any marketing.
• You are responsible for maintaining the security of your account and password. American Driving Academy cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
• By purchasing from American Driving Academy, you agree not to initiate any credit card chargeback, or dispute any payment made for services, products, digital goods, Vouchers or gift cards purchased, except in cases of proven fraud or unauthorized transactions. All disputes must be resolved directly with American Driving Academy.
• You must not post or submit false information to the Service.
• You must not use the Service for any illegal or unauthorised purpose. You must not use this Service to violate any laws in your jurisdiction, including but not limited to copyright laws.
• You are responsible for all activity that occurs from your account.
• Accounts registered by "bots" or other automated methods are not permitted and will be removed.
• American Driving Academy has the right to suspend or terminate your account, refuse any current or future use of the Service, or any other American Driving Academy service, for any reason.
• Violation of any of the terms or general conditions may result in the termination of your Account.
• In the event that you breach these Terms of Service, or act in a way that puts the Service or any individual at risk, American Driving Academy has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other American Driving Academy service. Such termination of the Service will result in the deactivation of your Account.

Cancellation Rates

• Less than 18 hours notice before the booking will forfeit $55.00.

A cancellation does not automatically refund payment of products or services. Any amount not subject to the cancellation fee, is credited towards your account balance at American Driving Academy.

 

Refund Policy

Refund Policy: Testing

1. Drivers license tests and permit tests cost the amounts stated on our website. Costs vary by location.
2. The customer will be refunded in the full amount, if the scheduled appointment is canceled at least 18 hours in advance of the scheduled appointment’s start time.
3. The customer will not be issued a refund and will forfeit the dollar amount paid for the service after canceling an appointment within 18 hours of the scheduled appointment time.
4. The customer will not be issued a refund and will forfeit the dollar amount paid for the service if they arrive at the testing location (present inside our office) more than 5 minutes late to their scheduled appointment start time.
5. The customer will not be issued a refund and will forfeit the dollar amount paid for the service if they are ineligible to take the test. It is the customer’s responsibility to know the requirements in order to be eligible to test. Testing requirements can be found on our website, the DMV’s website, and our office staff can provide information to help answer any questions about the requirements. If you are under the age of 18 years old, you are required to hold your permit for at least 1 full year from the issue date to be eligible to take a drive test.
6. If there is snow or ice on the road and the customer does not feel comfortable testing in those conditions, they can cancel their test up to 1 hour before the test time and re-schedule at no charge. Please note: According to state standards if the car slips, spins, or slides on the test it is an automatic fail so make sure you take it slow and easy.
7. The customer understands that we cannot guarantee that any service will be on a specific day at a specific time.
8. We have the right to refuse service for any reason. Refunds will be at the company’s discretion. 

This agreement constitutes the entire contract between American Driving Academy and
the customer, and any verbal assurances or promises not contained herein are not binding on either American Driving Academy or the customer.

Refund Policy: Driving Lessons

1. Private driving instruction is at a rate of $75 per hour in Denver/Aurora/Westminster/Longmont and surrounding areas, $70 per hour in Colorado Springs and surrounding areas, and $65 per hour in Pueblo and surrounding areas.
2. Lesson dates and times can be viewed on our website.
3. The customer will forfeit $55 of the driving lesson cost after canceling an appointment within 18 hours of the scheduled appointment time.
4. The customer will forfeit $55 of the driving lesson cost if they arrive at our driving lesson location more than 5 minutes late to their scheduled appointment start time.
5. The customer will forfeit $55 of the driving lesson cost if they are ineligible to go on the lesson. It is the customer’s responsibility to know the requirements in order to be eligible for a driving lesson. These requirements can be found on our website, the DMV’s website, and our office staff can provide information to help answer any questions about the requirements.
6. Driving lessons are normally 2 hours long but may be given up to 4 hours long at the special request by the customer.
7. Depending on CDC guidelines, students may be required to wear a mask while in the vehicle and have their temperatures taken before the lesson.
8. The lesson purchased will expire 18 months after purchasing the lesson. Refunds will not be given after a service has expired.
9. The customer understands that we cannot guarantee that any service will be on a specific day at a specific time.
10. We have the right to refuse service for any reason. Refunds will be at the company’s discretion.

The loss of any forms could mean a one-to-two-week delay in receiving your instruction permit or driver’s license.

         This agreement constitutes the entire contract between American Driving Academy and the customer in relation to driving lessons, and any verbal assurances or promises not contained herein are not binding on either American Driving Academy or the customer.

Refund Policy: Full-Program / 30hr class

1. The driver’s education course (30 hours classroom, 6 hours driving, and the permit test) will cost $495 in Colorado Springs and surrounding areas, $515 in the Denver/Aurora/Westminster/Longmont and surrounding areas, and $470 in Pueblo and surrounding areas. 30-hour classroom only is $195 for all locations.
2. Once signing up for a class, the $50 deposit is non-refundable. This deposit reserves a customer’s spot in the class. Payment for the class is due by the 1st day of class.
3. The customer will not be issued a refund for the classroom portion of our full-program once day 3 of the scheduled 30-hour class has concluded.
4. Class dates and times can be viewed on our web site at americandrivingacademy.com
5. Students must be at least 14 years and 6 months old on the first day of class to get credit for the 30 hours.
6. To get credit for completing the 30 hours, students need to show up on time for all 5 classes. Students also need to complete the 2 hours of homework and score at least an 80% on the final exam.
7. Depending on CDC guidelines, students may be required to wear a mask while in class or in our vehicles and have temperatures taken beforehand.
8. The service purchased will expire 18 months after day one of the scheduled 30-hour class. Refunds will not be given after a service has expired.
9. Students will receive up to 4 attempts on the permit test (written test). Testing will be done outside of the scheduled class time. Students must be at least 14 years and 11 months old before taking the permit test.

Vouchers

• Vouchers are non-refundable and cannot be redeemed for cash.
• Unused vouchers cannot be transferred between clients.
• Vouchers are valid for 24 months from the date of purchase.

Fees

• Credit card security is implemented using secure SSL encryption on all transactions and processed using a secure, trusted, PCI compliant payment gateway and used by American Driving Academy for payment processing.
• All fees and transactions are in United States Dollars.

General Conditions

• Your use of this website is at your sole risk. The website is provided on an "as is" and "as available" basis.
• You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the website, use of the website, or access to the website without the express written permission by American Driving Academy.
• Verbal, physical, written or other abuse (including threats of abuse or retribution) of any American Driving Academy customer, employee, member, instructor, officer or external contractor will result in immediate account termination.
• You must not transmit any worms or viruses or any code of a destructive nature.
• You understand that American Driving Academy uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run.
• American Driving Academy does not warrant that (i) the website will meet your specific requirements, (ii) the website will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the website will be accurate or reliable, (iv) the quality of any products, websites, information, or other material purchased or obtained by you through the website will meet your expectations, and (v) any errors in the website will be corrected.
• You expressly understand and agree that American Driving Academy shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if American Driving Academy has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the website; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information or services purchased or obtained or messages received or transactions entered into through or from the website; (iii) unauthorised access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the website; (v) or any other matter relating to the website.
• The failure of American Driving Academy to exercise or enforce any right or provision of the Terms of website shall not constitute a waiver of such right or provision.
• You expressly understand and agree that American Driving Academy shall not be liable for any indirect, incidental, special, consequential loss, loss or corruption of data or exemplary damages, including but not limited to loss resulting from the use or the inability to use the website or the Service.
